Resolution of disputes through commercial arbitration and commercial mediation

Currently, the trend of resolving disputes through Commercial Arbitration or Commercial Mediation is increasingly being chosen by businesses, particularly those with foreign elements.

The decision to resolve disputes through Commercial Arbitration is often based on its advantages, including flexible procedures, arbitrators who are experts in the relevant business sector, time efficiency, and the fact that arbitral awards are final and binding, meaning they cannot be appealed or protested and are enforceable on all parties.

On the other hand, Commercial Mediation is a relatively new dispute resolution method for many Vietnamese businesses. However, it is expected to gain more traction in the near future as it emphasizes the parties’ mutual agreement. When disputing parties are not in severe conflict and are willing to resolve their disputes through negotiation, aiming to maintain a cooperative relationship, Commercial Mediation becomes a viable and effective solution.

As legal representatives, we assist and advise clients in selecting the most suitable dispute resolution method while also gathering, analyzing, and evaluating evidence to support negotiations and discussions throughout the dispute resolution process in both Commercial Arbitration and Commercial Mediation.
